The ATS Professional Learning Center, Technology & Small Business Courses, Certification Testing, Virtual Office Memberships and Business & Consulting Services (the “Services”) are services operated by Academic & Technology Solutions, LLC, (“ATS” or “Company”) of 1950 Spectrum Circle SE, Suite B-370, Marietta, Georgia, USA. This Agreement, which governs the terms and conditions of your use of the ATS Professional Learning Center and Associated Services, is between you (“You,” “User,” “Renter,” “Member,” or “Client”), as an authorized user of the Services, and the Company. Client agrees that the Services will be used only as provided in such terms and conditions for legitimate business and education purposes.

COURSE REGISTRATION

2. INCLEMENT WEATHER CANCELLATION
If a class is canceled due to severe weather, you will be offered a seat in the next session or a credit for another class. Refunds are not available under these circumstances.

3. CANCELLATIONS & REFUNDS
We understand that unforeseen situations do arise, and that you may not be able to attend a course as scheduled. We will make every effort to work with you to reschedule you for the next available session that fits your schedule.

(A) All cancellations and refunds must be requested and completed during our published business hours, 10am-5pm.
(B)
If you cancel your registration 5 business days before the first class session, we will issue a credit voucher (valid for six months) for the full price of the class, or you may request a refund for the price of the course less a $60 administrative fee. 
(C)
If you cancel your registration less than 5 business days before the first class session, you will be entitled to a class credit Voucher (valid for six months) valued at 75% of the class price, or alternatively refund 50% of the price of the course. 
(D)
If you cancel on the day of the first class session and before the class begins, you will be entitled to a class credit Voucher (valid for six months) valued at 50% of the class price. No refunds will be given.
(E) No refunds or credit vouchers will be given after the class begins. As we have absorbed all of the costs of the class, we cannot make any exceptions.
(G) Classes with more than one date are sold as a complete course. Please arrange your schedule to include all sessions.
(H) No refunds, credits or transfers will be given for partially attended classes.
(I) You may transfer your registration to another person if you cannot take a class after registration. This change must be made in writing and completed prior to the first class session.
(J) A full refund will be given if a class is cancelled by the ATS Professional Learning Center.
(K) ATS Professional Learning Center reserves the right to cancel classes with low enrollment or due to circumstances beyond our control. Our liability is strictly limited to the class fee collected.

5. CONFIRMATIONS
ATS Professional Learning Center provides written confirmation of your registration via email. Hard copy (paper) receipts are available by request only.

6. OUR GUARANTEE
Our courses are regularly evaluated by participants; however, not all classes are right for everyone. If you are dissatisfied for any reason, please let us know via email at turnontech@atslearn.com, in person at the facility, or by phone at 770-726-9960. We will work with you to achieve your satisfaction with our services. This policy applies only to classes governed by ATS Professional Learning Center at our Marietta facility or using our online course system.

7. PRIVACY
Our subscriber lists are NEVER made available to other companies or individuals. We value every subscriber and respect your privacy. At times, you may receive emails from other divisions of Academic & Technology Solutions, LLC. If at any time you wish to cancel your subscription, please let us know or use the Unsubscribe link at the bottom of every email.

CERTIFICATION TESTING

Microsoft Office Specialist, Microsoft Technology Associate, CompTIA Strata, Adobe Certified Associate, Internet & Core Computing Certification and QuickBooks Certified User Exams

  1. 48 hours notice is required for online exam seat reservations, but 24 hour or same day appointments may be available when registering and completing payment by phone Monday through Friday during normal business hours.
  2. Exam fees are due at the time of reservation, and appointments can not be confirmed until payment is received.
  3. In the event that a candidate does not pass his or her certification examination, the exam may be repeated according to the certifying authority’s guidelines. The retake fee for Microsoft Office Specialist exams only is $75. The retake examination must be completed within 30 calendar days, otherwise a new registration at the then-current full price is required. All other examinations must be retaken at the full registration price.
  4. The current examination fees are available at www.atslearn.com/examregistration.

MEETING ROOM RENTAL, VIRTUAL OFFICE USE, AND MAIL SERVICES

Meeting Room Rental:
Day Office (1-3 people) | Training Classroom (up to 15 people) | Conference Room (up to 10 people)

All meeting room rental reservations and agreements are made upon, and subject to, the following conditions:

  1. Reservations are requested a minimum of 10 business days before your meeting or event. Virtual Office Members may make their room  reservations online using our Members Only reservation application.
  2. The room rental is not considered confirmed until ATS Professional Learning Center (ATS) has received your 50% deposit.
  3. The room rental charges include the actual meeting time plus any setup/cleanup time required by the Renter. ATS accepts credit cards in our office and online.
  4. Meeting rooms are rented to members at a rate based on their membership level at an hourly or full-day basis. Non-members may rent available rooms at our current posted hourly or day rate.
  5. The basic rental covers chairs, tables, LCD projector, single laptop computer. Additional laptops may be rented hourly or daily per unit.
  6. Renter may bring food and non-alcoholic beverages into the function or meeting.  ATS Professional Learning Center will provide, upon request, a list of local caterers/restaurants. As an alternative, Renter may request the Conference Center to handle all catering arrangements, in which case a service fee will be added to the total rental charges.
  7. Everything brought into the building or facility by Renter (food, beverages, decorations and trash) must be removed at the conclusion of the event or meeting.
  8. Decorations may not be attached to the building or any interior walls by using nails, staples, or tacks. ATS reserves the right to assess an additional charge for violating this provision.
  9. Renter agrees to be responsible for any damage done to the meeting room or any other part of the ATS facility or equipment by Renter or Renter’s attendees. Repair costs will be charged to the responsible party for any damage to the property or missing equipment.
  10. Renter is solely responsible for removing any meeting materials (papers, charts, etc.) from the ATS premises at the conclusion of the function. ATS will dispose of any materials remaining on the site after the event or meeting.
  11. These terms shall be considered to be in full force and effect and legally binding upon both parties upon execution by both parties. Execution is in effect upon receipt of rental deposit by ATS staff or designated representatives.
  12. The Renter agrees to indemnify and hold ATS harmless from any and all losses, damages, or expense resulting from any action, suit or any proceeding arising out of, or in any way related to, Renter’s negligence. Further, the Renter agrees to defend ATS in the event ATS is forced to defend an action or suit brought against ATS as a result of Renter’s negligence.

Virtual Office Memberships

Membership Services
ATS provides ready-to-use professional office and virtual office solutions to registered Members. Our space is furnished, staffed, equipped and wired inclusive within a single membership fee. Membership affords the Member access to complete services including use of the space, front-desk staff, high speed internet, and a set number of office hours as designated by membership level. Meeting, training, and conference room use beyond the number of hours included in a Member’s plan may be rented at a Member’s Only reduced rate. Membership plan hours do not accumulate and cannot be transferred to other months. Upon initiation of membership the Member is required to provide proper government-issued identification with clearly visible picture and signature of which a copy will remain on file at the ATS facility.

Membership Fees
Monthly membership and associated service fees are payable in advance and are non-refundable. Invoices for the upcoming month will be delivered via electronic mail by the 18th of the current month are due on the 1st. If a Member should have any question regarding any charges on an invoice, they must be submitted in writing via electronic mail to TurnOnTech(at)ATSLearn.com by Member no later than the 15th of the applicable month. Payments or disputes of charges not received by the 15th of the month will result in the immediate suspension of membership privileges. Failure to use membership will not be deemed a basis for refusing to pay any charges submitted by the Company in accordance with this Agreement. From time to time, monthly fees will change, with 30-day advance notice to Members.

Membership Cancellation
ATS Virtual Office Membership  is offered on a month-to-month basis only and may be discontinued at any time by emailing your cancellation request to TurnOnTech(at)ATSLearn.com. Upon receiving confirmation email from the Company, the Member’s plan will expire effective the last business day of the current month.

“Drop-In” Rental (Day Office Only)

Renter understands and agrees to the following: ATS Professional Learning Center (ATS) offers to provide a semi-private work-space for my use on a “drop-in,”“first come, first served” basis (based on availability) during regular business hours in exchange for a flat day rate of $40.00 paid to ATS on arrival by cash or credit card. Same day reservations are accepted based on room availability and must be pre-paid at the time of reservation by phone via credit card.

Renter and any Guests of the Renter are invitees of ATS and its parent, Academic & Technology Solutions, LLC, and are not entitled to any other rights or privileges. Renter will use the work space only for the purposes permitted by ATS as set forth on its website; Renter’s failure to comply with ATS rules for my use may result in the cancellation of my privileges and expulsion from the premises. Renter hereby releases ATS and its parent from any liability, loss or injury suffered by Renter or Renter’s Guests in the event of, but not limited to, accident, theft, damage to or unavailability of the premises due to circumstances beyond ATS management or control. ATS does not provide exclusive secure storage space. Should I elect to store personal property at ATS, Renter retains sole responsibility for the property. Renter assumes sole responsibility for any damage or loss suffered by ATS and/or its parent, due to Renter’s or Renter’s Guests’ intentional misuse of the work space or failure to use due care. ATS reserves the right to change its Rates and Terms and Conditions at any time and will provide reasonable advance notice in writing.

Business Address & Mail Forwarding Service

The United States Postal Service (USPS) requires the following compliance from the Mail Client under the provisions of Rule 66, Federal Register 56993, November 14, 2001, which govern Commercial Mail Receiving Agencies (CMRA). You agree to make the address format for Your business the following: Client Name, 1950 Spectrum Circle SE, Suite B-370, Marietta, GA 30067. Your failure to comply with this regulation may, at our sole discretion, be declared an act of default. You agree to furnish us with a completed and fully NOTARIZED CMRA Form 1583. Before mail may be received or any other location-related Services may be reserved or used, all persons for whom we handle mail, or who collects mail from the location, must provide us with a Government issued photo ID, plus one other form of acceptable identification, as specified in Form 1583. Any client that has reserved a virtual office location is required to provide proper identification and fully notarized forms with clearly visible stamp or seal as stated above, no matter the country of origin.

NOTE: DBA’s or additional company names require separate CMRA forms and will incur additional charges for virtual office address services.

Acceptable identification includes: valid driver’s license or state non-driver’s identification card; armed forces, government, university, or recognized corporate identification card; passport, alien registration card or certificate of naturalization; current lease, mortgage or Deed of Trust; voter or vehicle registration card; or a home or vehicle insurance policy. A photocopy of your identification may be retained by agent for verification.  Social Security Cards, Birth Certificates, Credit Cards are not acceptable.

User agrees to abide by all CMRA rules and regulations. At termination of this Agreement, You agree that all mail thereafter will be marked by ATS, “Return to Sender,” and no further mail or deliveries will be accepted. Client may use the address of ATS Professional Learning Center as specified above in this Agreement as Client’s business address, but not as Client’s registered office address. Mail will be handled according to instructions specified by the Client by selection of a Mail Service Plan, and the Client will be responsible for all resulting forwarding and service charges. Any violation of USPS regulations may result in termination of Services by ATS, and may subject the violator to fines or imprisonment. If ATS has been instructed to forward mail, neither ATS nor its agents shall be responsible for any delay or loss of mail during the forwarding process. ATS will not forward any items exceeding 10 lbs in weight, 18″ in any dimension, or 1 cubic foot in volume, and will not forward any item if the item contains any dangerous, live or perishable goods, and ATS shall be entitled in its absolute discretion to returned uncollected items or refuse to accept any quantity of items it considers unreasonable or unlawful. The Client warrants that it will not use any of the Services for any obscene, illegal, immoral or defamatory purposes and will not in any way bring ATS into disrepute. The Client will not in any way use or combine the Academic & Technology Solutions, LLC or ATS Professional Learning Center name, in whole or in part, for the purpose of trading activities. ATS will not be liable for any loss sustained as a result of any mechanical breakdown, strike, delay or failure of any staff, manager or caretaker to perform their duties. This Agreement is interpreted and enforced in accordance with the laws of the state of Georgia, USA.

WEB AND GRAPHIC DESIGN

1. DEPOSIT
Upon signed contract approval by the Client, a 50% deposit is required to begin design services. E-mailed approvals are acceptable if accompanied by deposit. Website design and hosting packages that are offered at discounted rates must be paid in full at the time of your order.

2. TIMELINE
The timeline for your project is included in the written contract. All adjustments to this timeline must be made in writing and approved by both the client and the Academic & Technology Solutions designer assigned to your project.

3. PROJECT COMPLETION
Upon final approval of the completed project, all balances are immediately due unless otherwise specified in the individual contract. Final work products will not be released until payment is received.

4. PROJECT CANCELLATION
We begin working on your project as soon as a deposit is received in order to provide you with quality service and a speedy turnaround time. In the event that you choose to cancel your project after making your deposit, notification is required in writing. Cancellations received within 5 business days of deposit are 100% refundable. Cancellations received within 10 business days of deposit are refundable less 50%. Cancellations received 11 business days or more after deposit are not refundable for any reason.

GIFT CERTIFICATES

Gift certificates retain their full value for twelve (12) months from purchase. Certificates can be used towards payment for any public courses, services, or exams offered at the ATS Professional Learning Center. Certificates can not be used for payment of corporate or government learning contracts. Refunds for Gift Certificates are subject to the terms indicated in the Course Registration section above.

CHANGES TO ATS POLICIES AND THESE TERMS

The contents of this website, including these Terms & Conditions, procedural policies, and any information contained on this website are subject to change and to being updated without notice from time to time. If a change does occur, the amended Agreement will be posted on this page. The date the Agreement was last revised will be indicated at the top of this page. Your continued use of ATS Services after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to any of these terms or any future Terms of Use, do not use or access (or continue to access) the Services. This Agreement applies to all visitors, users, and others who access the Service (“Users”).
